Terms of Service

Agreement to these terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you", "your", "user") and Divinely.me ("Divinely", "we", "us", "our"). By registering an account, accessing, or using the Divinely service at divinely.me (the "Service"), you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

If you do not agree to these Terms, you must not access or use the Service. We reserve the right to update these Terms at any time. We will provide at least 14 days' notice of material changes by email. Continued use of the Service after the effective date of any change constitutes your acceptance of the revised Terms.

What Divinely is — and is not

Divinely is an AI-powered spiritual companion, not a licensed pastoral counsellor, therapist, medical professional, crisis service, or religious authority. All responses are generated by artificial intelligence and may contain errors or inaccuracies.

Divinely is designed to provide faith-based reflection, scripture references, and spiritual encouragement. It is expressly not a substitute for:

  • Pastoral counselling or spiritual direction from an ordained minister or qualified religious leader
  • Licensed mental health therapy, psychiatric treatment, or counselling
  • Medical, legal, financial, or professional advice of any kind
  • Sacramental ministry, confession, or authoritative doctrinal teaching
  • Emergency mental health services or crisis intervention

If you are experiencing a mental health crisis, suicidal thoughts, domestic abuse, or any emergency, please contact the emergency services or a crisis helpline immediately. In the UK and Ireland: Samaritans 116 123 (free, 24/7). In Europe: find your national helpline at befrienders.org.

Eligibility

To use Divinely you must:

  • Be at least 16 years of age (or the age of digital consent in your jurisdiction, if higher)
  • Have the legal capacity to enter into a binding contract
  • Not be prohibited from using the service under the laws of any applicable jurisdiction
  • Not have had a previous account terminated for breach of these Terms

If you are using Divinely on behalf of an organisation, you represent and warrant that you have the authority to bind that organisation to these Terms, and references to "you" include that organisation.

Your account

  • You must provide accurate, current, and complete information when creating your account and keep it up to date.
  • You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
  • You must notify us immediately at support@divinely.me if you become aware of any unauthorised access to or use of your account.
  • One account per individual. Creating duplicate accounts to circumvent usage limits, bans, or restrictions is prohibited and may result in termination of all associated accounts.
  • You may not transfer your account to another person.
  • We reserve the right to refuse registration or cancel accounts at our sole discretion.

Acceptable use

You agree to use Divinely only for lawful purposes and in accordance with these Terms. You must not use the Service to:

  • Generate, share, or promote content that is unlawful, defamatory, abusive, threatening, harassing, discriminatory, hateful, or violent
  • Impersonate any person, religious authority, denomination, or organisation, or misrepresent your affiliation with any entity
  • Attempt to manipulate, deceive, bypass, jailbreak, or circumvent the AI system or any safety measures
  • Scrape, harvest, or systematically extract data, content, or AI outputs from the Service for commercial purposes
  • Reproduce, distribute, modify, create derivative works from, or publicly display any part of the Service without our express written permission
  • Upload or transmit malicious code, viruses, or any software designed to disrupt, damage, or gain unauthorised access to any system
  • Violate any applicable local, national, or international law or regulation, including data protection, intellectual property, and anti-spam laws
  • Use automated tools, bots, or scripts to access the Service without our prior written consent
  • Share access to a paid account with others in a manner that constitutes commercial sublicensing or defrauds Divinely of subscription revenue

Violation of any of the above may result in immediate account suspension or permanent termination, without notice and without refund, at our sole discretion. We reserve the right to report serious violations to relevant authorities.

AI-generated content

All responses are generated by artificial intelligence (currently Google Gemini) and are subject to the following conditions:

  • AI-generated content does not constitute professional, pastoral, medical, legal, or financial advice of any kind.
  • Responses may contain theological interpretations, scripture references, or doctrinal positions that do not reflect your tradition or that are factually inaccurate. We do not warrant their theological correctness.
  • You should verify any AI-generated content against authoritative sources — including your pastor, denomination, or your own study of scripture — before acting on it.
  • Divinely is not affiliated with any denomination, church, or theological institution and does not claim to represent the official position of any faith tradition.
  • AI responses are generated fresh each session and may vary. Divinely has no memory of prior conversations unless you have enabled conversation history on a paid plan.

Ownership of your content: You retain full ownership of all content you submit to the Service (messages, journal entries, prayer requests). By submitting content, you grant Divinely a limited, non-exclusive, royalty-free licence to store, process, and transmit your content solely as necessary to provide the Service. We do not use your content to train AI models.

Subscriptions, billing, and refunds

  • Free plan: up to 5 messages per day at no charge. No payment method required. Free features may be changed or restricted at any time with reasonable notice.
  • Paid plans (Standard and Max): billed monthly in advance via Stripe. Prices are shown in your local currency. Subscriptions auto-renew at the end of each billing period unless cancelled.
  • Annual plans: where offered, billed annually in advance at a discounted rate. The full annual amount is charged at the start of each period.
  • Cancellation: you may cancel at any time from Settings → Billing. Your access continues until the end of the current billing period. No partial refunds are issued for unused time within a billing period, except as set out below.
  • 7-day satisfaction guarantee: if you are dissatisfied with your first paid subscription period, email support@divinely.me within 7 days of your first charge and we will issue a full refund, no questions asked. This applies once per customer.
  • Price changes: we will give at least 30 days' email notice of any price increases before they apply to your account. You may cancel before the new price takes effect.
  • Failed payments: if a payment fails, we will notify you by email and retry after 3 and 7 days. After three failed attempts, your account will be downgraded to the free plan. You may resubscribe at any time.
  • Taxes: prices may be exclusive of VAT or other applicable taxes, which will be added at checkout where required by law.

Intellectual property

The Divinely name, wordmark, logo, product design, interface, and underlying codebase are the exclusive property of Divinely.me and are protected by applicable intellectual property laws. All rights not expressly granted in these Terms are reserved.

You may not copy, modify, distribute, sell, sublicense, reverse engineer, decompile, or create derivative works of any part of the Service without our prior written consent. Unauthorised use of our intellectual property may give rise to a claim for damages and/or be a criminal offence.

The AI models underlying Divinely are owned and operated by Google LLC. Use of AI-generated outputs is also subject to Google's terms of service for the Gemini API.

Any feedback, suggestions, or ideas you submit to us may be used by Divinely without restriction or compensation to you.

Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

  • We do not warrant that the Service will be uninterrupted, error-free, secure, or free from viruses or other harmful components.
  • We do not warrant the accuracy, completeness, or theological correctness of any AI-generated content.
  • We reserve the right to suspend, modify, or discontinue the Service or any part of it at any time, with or without notice, without liability to you.
  • Third-party websites or services linked from Divinely are not under our control and we are not responsible for their content or privacy practices.

Limitation of liability

To the fullest extent permitted by applicable law, Divinely and its officers, directors, employees, affiliates, agents, and licensors shall not be liable for:

  • Any indirect, incidental, special, consequential, punitive, or exemplary damages
  • Loss of profits, revenue, data, goodwill, or business opportunities
  • Damages arising from your reliance on AI-generated content
  • Unauthorised access to or alteration of your data (except where caused by our negligence)
  • Any matter beyond our reasonable control (force majeure)

Our total aggregate liability to you for any and all claims arising from or relating to your use of the Service shall not exceed the greater of: (a) the total amount you paid to us in the 12 months immediately preceding the event giving rise to the claim; or (b) £50 (fifty pounds sterling).

Nothing in these Terms excludes or limits liability for: (i) death or personal injury caused by our negligence; (ii) fraud or fraudulent misrepresentation; (iii) any liability that cannot be excluded by law, including EU and UK statutory consumer rights. EU consumers retain the benefit of any mandatory consumer protections available under the laws of their country of residence.

Indemnification

You agree to indemnify, defend, and hold harmless Divinely and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the Service in breach of these Terms; (b) your violation of any applicable law or third-party rights; or (c) any content you submit to the Service.

Termination

You may close your account at any time from Settings → Account → Delete account. We may suspend or terminate your account, with or without notice, if:

  • You breach any provision of these Terms
  • We are required to do so by law or a competent authority
  • We reasonably believe your account is being used fraudulently
  • Continued operation of your account creates legal, reputational, or security risks

On termination: your access to the Service ceases immediately; your personal data will be handled in accordance with our Privacy Policy; provisions of these Terms that by their nature should survive (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) shall survive termination.

Governing law and dispute resolution

These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.

Before initiating formal proceedings, you agree to attempt to resolve any dispute with us informally by emailing support@divinely.me. We will use reasonable efforts to resolve the dispute within 30 days.

If informal resolution fails, disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, subject to any mandatory consumer law rights you may have in your country of residence. EU consumers may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

Miscellaneous

  • Entire agreement: these Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Divinely regarding the Service and supersede all prior agreements.
  • Severability: if any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
  • Waiver: our failure to enforce any right or provision of these Terms will not be deemed a waiver of that right or provision.
  • Assignment: you may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights without restriction.
  • No third-party rights: these Terms do not give rise to any rights enforceable by third parties under the Contracts (Rights of Third Parties) Act 1999 or otherwise.
